Community Driven Values

Actcentive is a community driven initiative of online services where all personal information is handled under an opt in understanding. No personal information is ever shared or sent to any third party, all shared personal information is only allowed with your consent.

If a third party requests your personal information, we will refuse to share it unless you give us permission, or we are legally required. When we are legally required to share your personal information, we will tell you in advance, unless we are legally forbidden.

Protecting Your Privacy

Actcentive use data to make shopping through our marketplaces more convenient for members and customers. Protecting your privacy and the security of your data will always be our top priority.

 

Trusting us with your data means that you don’t have to enter your payment and delivery information every time you make an order.

Information We Process

We generally process your information when we need to do so to fulfil a contractual obligation (for example, to process your subscription payments to use the Actcentive platform Marketplace), or where we or someone we work with needs to use your personal information for a reason related to their business (for example, to provide you with a service).   • Preventing risk and fraud
  • Answering questions or providing other types of support
  • Assist vendors with questions and support
  • Assisting with marketing, advertising, or other communications

Depending on how you use Actcentive, you may have the right to request access to, correct, amend, delete, port to another service provider, restrict, or object to certain uses of your personal information (for example, direct marketing). We will not charge you more or provide you with a different level of service if you exercise any of these rights.

 

If you buy something from an Actcentive Marketplace store and wish to exercise these rights over information about your purchase, you need to directly contact the vendor you interacted with. We are only a processor on their behalf, and cannot decide how to process their information. As such, we can only forward your request to them to allow them to respond. We will of course help our vendor to fulfil these requests by giving them the tools to do so and by answering their questions.

 

Please note that if you send us a request relating to your personal information, we have to make sure that it is you before we can respond. In order to process your marketplace subscription, we may ask to see documentation verifying your identity, which we will discard after verification. Refer to the marketplace subscription level to understand the approval requirements.

 

If you would like to designate an authorized agent to exercise your rights for you, please email us from the email address we have on file for you. If you email us from a different email address, we cannot determine if the request is coming from you and will not be able to accommodate your request. In your email, please include the name and email address of your authorized agent.

 

If you are not happy with our response to a request, you can contact us to resolve the issue. You also have the right to contact your local data protection or privacy authority at any time. Finally, because there is no common understanding about what a “Do Not Track” signal is supposed to mean, we don’t respond to those signals in any particular way.

 

Where We Send Your Information

We are a United Kingdom company, but we work with and process data about individuals across the world. To operate our business, we may send your personal information outside of your state, province, or country, including to the United States.

 

This data may be subject to the laws of the countries where we send it. Content and Communications

All Actcentive members that post content, comments, queries, and reviews require a validated membership account. Validated accounts require a real email address and proof of ownership is required during the initial sign up.

 

Content, defined as (“content”) including any reviews, articles, products, comments, customer questions or answers, images, video, or audio.

 

If you submit reviews, articles, products, comments, customer questions or answers, or other content that is generated by you for display on the platform  you grant Actcentive (a) a non-exclusive, royalty-free licence to use, reproduce, publish, make available, translate and modify such content throughout the world. This does not include the right to sublicense these rights to third parties. No moral rights are transferred by this provision.

 

You may delete your content from public view or, where such functionality is offered, and change privacy settings so that it is only shown to people to whom you grant access.

 

All content, comments, queries, content, and other communications will be moderated and must comply to the following rules:

  • Content is not illegal
  • Obscene
  • Abusive
  • Threatening
  • Defamatory
  • Invasive of privacy
  • Infringing of intellectual property rights
  • Injurious to third parties or objectionable
  • Does not consist of or contain software viruses
  • Political campaigning
  • Commercial solicitation
  • Chain letters
  • Mass mailings or any form of “spam”
  • You may not use a false e-mail address
  • Impersonate any person or entity,
  • Mislead as to the origin of content.

 

Actcentive reserve the right to remove or edit such content.

Electronic Communications

When you use any Actcentive Platform Services or send e-mails to us, you are communicating with us electronically. We will communicate with you electronically in a variety of ways, such as by e-mail, web push notices and communications on the website or through the other Actcentive Notification Services, such as our store “Notification Boards” or “Announcements”.

 

For contractual purposes, you agree that all agreements, notices, and announcements received through the platform’s communications that we transmit to you electronically meet all legal requirement. All form of communications is in writing unless applicable laws specifically requires an alternative form of communication.

Recommendations & Personalisation

As part of the Actcentive Services, we will recommend features, articles, reviews, products, and services, including platform and third-party adverts.

Geo Location

When you sign up to a country specific marketplace store subscription level we use geo location data to determine product and service locations. This data assists customers in finding products within a defined distance from their location.

 

Actcentive uses the Google Maps API service, and we may capture the following parameters:

  • IP addresses
  • Latitude
  • Longitude
  • City
  • Country

 

This information is used to enhance the visitor’s experience when using the website to enable the Google Maps API service to allow geo-lookups.

 

Service Level Agreement

 

All Actcentive platform services are hosted by Microsoft Azure and fall under a Service Level Agreement for Microsoft Online Services (this “SLA”) is a part of the Microsoft volume licensing agreement (the “Agreement”).

How you can OPT OUT

Direct marketing. If you do not want to receive promotional messages from us, you can change your account settings or follow the unsubscribe instructions which we include at the bottom of our emails and text messages.

Not Enforce

EAN, UPC or Barcode Infringement: EANs, UPCs and Barcodes are used to associate product information i.e. pricing, size or inventory levels. These codes are not covered by intellectual property protection.

Detail Page Ownership and Image Restrictions: When a detail page is created, it becomes a permanent catalogue page on Actcentive.com that will remain even if the creator’s inventory sells out or they delete the product.
Other marketplace store owners can list their items for sale against pages that you have created or added your copyrighted images to. However, Actcentive requires that sellers list only against detail pages that exactly match their items.
If you believe sellers are listing against detail pages that do not exactly match their items, we ask that you report the violation the Actcentive Platform support.

 

If your copyrighted image has been added to our catalogue without your consent, please complete the Actcentive Report Infringement form.

 

Actcentive does not provide legal advice. However, if you have questions or concerns regarding your rights, you may wish to seek legal advice from a specialist.

Modifications to This Privacy Policy

From time to time, we may update this Privacy Policy. If we make any material change to it, we will notify you via email, through a notification posted on the Services, or as required by applicable law. We will also include a summary of the key changes. Unless stated otherwise, modifications will become effective on the day they are posted.

As permitted by applicable law, if you continue to use the Services after the effective date of any change, then your access and/or use will be deemed an acceptance of (and agreement to follow and be bound by) the revised Privacy Policy. The revised Privacy Policy supersedes all previous Privacy Policies.
